In these Terms and Conditions, the following definitions apply:
a. Animaux Troupeau: the seller and operator of the online store at animauxtroupeau.com;
b. customer: any natural person or legal entity that places an order through the online store;
c. consumer: a natural person acting for purposes outside their trade, business, craft or professional activity;
d. agreement: the purchase agreement concluded through the online store between Animaux Troupeau and the customer;
e. product: any item offered through the online store;
f. online store: the Animaux Troupeau website at animauxtroupeau.com and any associated localised or translated versions.
These Terms and Conditions apply to every offer made by Animaux Troupeau and to every order and agreement concluded through the online store.
Before the agreement is concluded, these Terms and Conditions are made available to the customer electronically. The customer may save or print them.
By placing an order, the customer confirms that they have read these Terms and Conditions.
Deviations from these Terms and Conditions are only valid if agreed with Animaux Troupeau in writing.
Separate terms may apply to business or wholesale orders. Consumer rights, including the statutory right of withdrawal, only apply where the customer acts as a consumer.
If any provision of these Terms and Conditions conflicts with mandatory consumer law, the mandatory consumer law will prevail.

Animaux Troupeau describes the products offered as fully and accurately as reasonably possible. The product page contains the principal characteristics, available sizes, materials and price of the product.
Images are intended to provide the best possible representation of the products. Colours may vary slightly due to screen settings, lighting conditions or production batches. A minor variation that does not affect the essential characteristics of the product does not constitute a defect.
Products may be available in limited quantities. An offer remains valid while stocks last, unless otherwise stated.
Obvious mistakes, typographical errors or evident inaccuracies in product information or prices are not binding on Animaux Troupeau. This only applies where it should have been clear to an average customer that an error had occurred.
Promotions, offers and discount codes apply during the stated period and subject to the conditions communicated with them.
Discount codes cannot be exchanged for cash and cannot be combined with other discount codes or promotions unless explicitly stated otherwise.
The customer places an order by adding products to the shopping cart, entering the requested information and completing the order through the payment environment.
Before placing the order, the customer is given the opportunity to review the order and the information provided and to correct it where necessary.
The agreement is concluded when Animaux Troupeau confirms the order by email.
An automated message confirming only that the order has been technically received may, in exceptional circumstances, be followed by an additional review, for example in the event of:
a. suspected fraud or misuse;
b. a technical error;
c. an obvious pricing error;
d. incorrect or incomplete customer information;
e. unexpected unavailability of the product.
If Animaux Troupeau is unable to fulfil an order after payment has been made, the customer will be informed as soon as possible and the amount paid will be refunded using the original payment method.
Animaux Troupeau may refuse or cancel an order where there is a reasonable and justified ground, for example fraud, misuse, payment problems, an obvious error or an order that is clearly intended for unauthorised resale.
All prices displayed to consumers include the applicable VAT.
Shipping costs and any other additional charges are clearly stated before the customer places the final order.
The final price displayed before checkout is the total amount payable by the customer for the order, excluding any import duties or local taxes applicable to deliveries outside the European Union.
For deliveries outside the European Union, import duties, customs clearance charges, local VAT or other levies may be charged by the authorities or delivery service in the destination country. These charges are payable by the customer unless explicitly stated otherwise.
Animaux Troupeau may change its prices. A price change does not affect an order that has already been confirmed, except in the case of an obvious pricing error.
The available payment methods are displayed during checkout.
Payments are processed through Shopify Payments and the financial service providers connected to it, among others.
The customer must provide correct and complete payment and invoicing information.
Animaux Troupeau is not required to dispatch an order until payment has been successfully completed or confirmed.
If a payment is reversed, declined or proves to be invalid, Animaux Troupeau may suspend fulfilment of the order or cancel the agreement.
The customer may not set off or suspend an amount due without a valid legal basis.
Animaux Troupeau delivers to the delivery address provided by the customer when placing the order.
Expected delivery times are stated on the online store and during the ordering process. Delivery times are estimates unless a fixed delivery date has explicitly been agreed.
Orders will in all cases be delivered within the period required by law, unless a different delivery period has been agreed with the customer.
If a product is offered as a pre-order, the expected dispatch or delivery period will be clearly stated on the product page.
If delivery is delayed, Animaux Troupeau will inform the customer as soon as possible.
If delivery does not take place within the agreed period, the consumer may give Animaux Troupeau a reasonable additional period in which to deliver. If delivery still does not take place within that additional period, the consumer may terminate the agreement.
No additional period is required where:
a. Animaux Troupeau has refused to deliver;
b. delivery by a specific date or time was essential and this was clearly agreed in advance; or
c. the circumstances show that timely delivery was essential.
If the agreement is terminated due to late delivery, any amounts already paid will be refunded as soon as possible and no later than within the period required by law.
The risk of loss of or damage to an order remains with Animaux Troupeau until the consumer, or a third party designated by the consumer other than the carrier, has received the order.
If the customer independently appoints a carrier that was not offered by Animaux Troupeau, the risk passes to the customer once Animaux Troupeau has handed the order to that carrier.
The customer is responsible for ensuring that the delivery address provided is correct and complete. Additional costs resulting from an incorrect or incomplete address provided by the customer may be charged to the customer insofar as this is reasonable.
A consumer has the right to withdraw from the agreement within fourteen days without giving any reason.
The withdrawal period begins on the day after:
a. the consumer, or a third party designated by the consumer, has received the product;
b. in the case of multiple products ordered in one order and delivered separately, the final product has been received;
c. in the case of a product consisting of several parts or shipments, the final part or shipment has been received.
Within the withdrawal period, the consumer may notify Animaux Troupeau that they wish to withdraw from the agreement by using:
a. the online withdrawal function on the online store;
b. the returns portal;
c. the model withdrawal form included at the end of these Terms and Conditions;
d. an email sent to info@animauxtroupeau.com; or
e. any other unequivocal statement showing that the consumer wishes to withdraw from the agreement.
It is sufficient for the consumer to send the withdrawal notification before the withdrawal period expires.
The consumer may use the online withdrawal function for as long as the statutory withdrawal period remains open. After submitting the withdrawal request, the consumer will receive electronic confirmation as soon as possible.
The right of withdrawal also applies to discounted products and products purchased during a promotion, unless a statutory exception applies.
Exercising the right of withdrawal is separate from the consumer’s statutory warranty rights. If a defective or incorrect product has been delivered, the provisions relating to statutory conformity apply and the costs of any necessary return are payable by Animaux Troupeau.
After notifying Animaux Troupeau of the withdrawal, the consumer must return the product no later than fourteen days from the date on which the withdrawal was communicated.
The return must be sent to the return address stated in the returns portal or return instructions. A return may not be sent to another address without prior approval.
The direct costs of returning the product are payable by the consumer, unless:
a. Animaux Troupeau has offered to pay those costs;
b. an incorrect product was delivered;
c. the product was delivered damaged or defective; or
d. the consumer was not properly informed in advance that the return costs would be payable by them.
The consumer may inspect, assess and try on the product in the same way as would reasonably be permitted in a physical store.
The consumer is only liable for any reduction in value resulting from handling the product beyond what was necessary to establish its nature, characteristics, size and functioning.
For clothing, this means that the product may be tried on indoors. During the assessment period, the product may not be worn while swimming, exercising or carrying out other activities and may not be washed, damaged, soiled or altered.
Removing labels does not automatically result in the loss of the statutory right of withdrawal. However, if removing labels or otherwise handling the product has demonstrably reduced its value, that reduction in value may be deducted from the refund.
The consumer is advised to retain proof of postage until the return has been fully processed.
In the event of a valid withdrawal, Animaux Troupeau will refund all payments received from the consumer in respect of the returned product.
If the entire order is withdrawn, the cost of the least expensive standard delivery method offered will also be refunded.
If only part of an order is returned, the original delivery costs will not be refunded where those costs would also have been incurred for the products retained by the consumer.
If the consumer chose a more expensive delivery method than the least expensive standard delivery method offered, Animaux Troupeau is not required to refund the additional cost.
Refunds will be made no later than fourteen days after Animaux Troupeau receives the withdrawal notification.
Animaux Troupeau may withhold the refund until:
a. the returned product has been received; or
b. the consumer has provided evidence that the product has been returned,
whichever occurs first.
The refund will be made using the same payment method used for the original transaction, unless a different payment method has explicitly been agreed.
No administration fee will be charged for the refund.
In addition to the statutory right of withdrawal, Animaux Troupeau offers consumers a voluntary returns period of thirty days in total from the date the order is received.
During the first fourteen days, all statutory provisions set out in Articles 8 to 10 remain fully applicable.
Returns requested after the statutory withdrawal period has expired, but within thirty days after receipt, are subject to the conditions of the voluntary returns policy.
To qualify under the voluntary returns policy, the product must:
a. be unworn and unused;
b. not have been washed;
c. be undamaged and clean;
d. be free from odours, stains, hairs or signs of use;
e. still have the original labels attached;
f. where reasonably possible, be returned in the original packaging.
Animaux Troupeau may refuse a return under the voluntary returns policy if these conditions have not been met. This does not affect the customer’s statutory warranty rights.
Return shipping costs under the voluntary returns policy are payable by the customer, unless the return is the result of an error or defect for which Animaux Troupeau is responsible.
Once the return has been received and approved, Animaux Troupeau will generally process the refund within seven working days using the original payment method.
Original shipping costs will not be refunded for a return made under the voluntary returns policy, unless Animaux Troupeau has explicitly agreed otherwise or mandatory law requires otherwise.
Exchanges are handled in accordance with the returns and exchanges policy on the online store. If the requested replacement product is no longer available, the purchase price of the returned product will be refunded.
The statutory right of withdrawal does not apply to products covered by a statutory exception, including:
products made to the consumer’s specifications that were not prefabricated;
products that are clearly personalised or intended for a specific person;
products that are liable to deteriorate or expire rapidly;
sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;
other products that are excluded from the right of withdrawal by law.
Animaux Troupeau will make clear before purchase where a statutory exception applies. The fact that a product is swimwear or clothing does not automatically mean that the right of withdrawal is excluded.
Animaux Troupeau warrants that a delivered product conforms to the agreement and possesses the characteristics that the consumer may reasonably expect on the basis of the agreement.
The statutory warranty does not have a fixed standard duration. What a consumer may reasonably expect from a product depends, among other things, on:
a. the nature of the product;
b. the price;
c. the product description;
d. the material;
e. normal use;
f. the information provided before purchase.
If a product does not conform to the agreement, the consumer must notify Animaux Troupeau as soon as reasonably possible after discovering the defect.
A notification made within two months after discovery of the defect will in all cases be regarded as timely.
Where a statutory warranty claim is justified, the consumer may in the first instance request repair or replacement free of charge, provided that the chosen remedy is possible and reasonable.
Repair or replacement will be carried out free of charge, within a reasonable period and without significant inconvenience to the consumer.
If repair or replacement is impossible, is not carried out within a reasonable period or does not adequately resolve the problem, the consumer may, subject to the statutory conditions, request a price reduction or termination of the agreement.
A consumer is not required to pay return, inspection, material or shipping costs where the defect falls within the statutory warranty.
The statutory warranty does not cover damage resulting from:
a. incorrect or improper use;
b. normal wear and tear;
c. failure to follow washing or care instructions;
d. incorrect washing, drying, ironing or dry cleaning;
e. contact with sharp objects or rough surfaces;
f. external causes arising after delivery;
g. alterations or repairs carried out by the customer or a third party without authorisation.
Commercial warranties, manufacturer warranties or additional service commitments do not restrict the consumer’s statutory warranty rights.
Customers are advised to follow the washing, usage and care instructions stated on the product label and product page.
Swimwear should be rinsed with clean water as soon as possible after use in salt water or chlorinated water.
Damage caused by incorrect care, prolonged exposure to chlorine, bleaching agents, sunscreen products, rough surfaces or other external circumstances does not automatically fall within the statutory warranty.
This Article does not restrict the consumer’s rights where the product does not possess the characteristics that may reasonably be expected under normal use.

When submitting a complaint, the customer is requested to provide:
a. their name and contact details;
b. the order number;
c. a clear description of the complaint;
d. where relevant, clear photographs of the product and the issue.
Animaux Troupeau will handle complaints carefully and respond within a reasonable period.
If more time is required to deal with a complaint, the customer will receive confirmation together with an indication of the further handling process.
The consumer must provide Animaux Troupeau with a reasonable opportunity to investigate the complaint and offer an appropriate remedy.
The customer is not required to retain the original packaging in order to exercise statutory rights in relation to a warranty complaint.
Where this option is offered, the customer may create a customer account.
The customer is responsible for providing correct and up-to-date information and for keeping their login details confidential.
The customer must inform Animaux Troupeau as soon as possible if they suspect that an unauthorised person has gained access to their account.
Animaux Troupeau may temporarily block or delete an account where:
a. fraud or misuse is involved;
b. the security of the account or online store is at risk;
c. the customer seriously breaches these Terms and Conditions;
d. this is necessary to comply with a legal obligation.
Deleting an account does not affect agreements already concluded, outstanding orders or information that must be retained by law.
The customer may not use the online store for unlawful or unauthorised purposes.
In particular, it is prohibited to:
a. distribute viruses, harmful code or malware;
b. circumvent security measures;
c. collect another person’s personal data without permission;
d. place an excessive load on the online store through automated systems;
e. scrape or copy content for commercial purposes;
f. provide false or misleading information;
g. infringe intellectual property rights;
h. commit fraud or use payment methods without authorisation.
Animaux Troupeau may restrict access to the online store where this is reasonably necessary for security, maintenance or preventing misuse.
All rights relating to the online store and its published content belong to Animaux Troupeau or its licensors.
This includes, among other things:
a. trade names and trademarks;
b. logos;
c. product names and designs;
d. photography and video;
e. text and product descriptions;
f. graphic design;
g. software and technical elements.
Without prior written permission, this content may not be copied, modified, published, distributed or commercially used, except for personal and non-commercial use.
The customer retains the rights to their own content provided to Animaux Troupeau.
Where a customer voluntarily submits a photograph, video or review, Animaux Troupeau may not use it for commercial publication without a valid legal basis or permission, unless different conditions were clearly agreed in advance.
The online store uses third-party services, including Shopify, Shopify Payments, delivery services and other technical service providers.
Links to third-party websites are provided solely for the user’s convenience.
Animaux Troupeau is not responsible for the content or availability of an external website over which it has no control.
If the customer enters directly into an agreement with an external party, the terms and conditions of that external party will apply.
This Article does not limit the responsibility of Animaux Troupeau for parties it engages to perform its own agreement with the customer, such as a delivery service selected by Animaux Troupeau.
Animaux Troupeau is liable for damage to the extent that such damage is attributable to it under applicable law.
Nothing in these Terms and Conditions excludes or limits liability for:
a. death or personal injury resulting from an attributable failure;
b. intent or deliberate recklessness;
c. product liability to the extent that it cannot legally be excluded;
d. infringement of mandatory consumer rights;
e. any other liability that cannot legally be excluded.
Animaux Troupeau is not liable for damage caused solely because the customer:
a. provided incorrect or incomplete information;
b. used the product in a manner other than could reasonably be intended;
c. failed to follow the care or usage instructions;
d. altered the product without authorisation.
For business customers, liability may, insofar as permitted by law, be limited to the amount paid for the relevant order or the amount paid out under the applicable liability insurance.
The limitations applicable to business customers do not apply to consumers.
Animaux Troupeau is not liable for delays or failures resulting from circumstances reasonably beyond its control.
Such circumstances may include:
a. natural disasters and extreme weather conditions;
b. war, terrorism or civil unrest;
c. government measures;
d. major disruptions to energy, internet or payment infrastructure;
e. epidemics or pandemics;
f. strikes that Animaux Troupeau could not reasonably prevent;
g. serious disruptions to international transport or supply chains.
Animaux Troupeau will inform the customer as soon as possible if a force majeure event affects an order.
If performance becomes permanently impossible, either party may terminate the agreement. Amounts already paid for products that have not been delivered will be refunded.
If delivery is only delayed, the consumer retains their statutory rights relating to late delivery.
Animaux Troupeau processes personal data in accordance with the Privacy Policy published on the online store.
The Privacy Policy explains which personal data is processed, for what purposes, with which parties it is shared and which privacy rights the customer has.
The use of cookies and similar technologies is explained in the Privacy Policy and cookie settings.
Animaux Troupeau may amend these Terms and Conditions where necessary due to changes in legislation, business operations, services or technical developments.
An order is governed by the version of the Terms and Conditions that the customer was able to review before placing that order.
Amendments do not apply retrospectively to agreements already concluded, unless this is legally required or is to the customer’s benefit.
The most recent version will be published on the online store together with the date of the latest update.
If any provision of these Terms and Conditions is found to be void, voidable or unenforceable, the remaining provisions will remain in effect.
The relevant provision will, where possible, be replaced by a valid provision that most closely reflects the purpose of the original provision without restricting mandatory consumer rights.
If Animaux Troupeau does not immediately exercise a right, this does not mean that it has waived that right.
The agreement and these Terms and Conditions are governed by Dutch law.
This choice of law does not deprive a consumer living in another country of the protection provided by mandatory consumer law applicable in the country where the consumer habitually resides.
The parties will first attempt to resolve any dispute through consultation.
If no resolution is reached, the dispute may be submitted to the court having jurisdiction under the applicable statutory rules.
A consumer is not required to submit a dispute exclusively to a court in Breda or any other location chosen by Animaux Troupeau.
These Terms and Conditions may be made available in different languages.
In the event of differences in interpretation, the Dutch version will prevail insofar as permitted by law.
Mandatory consumer rights applicable in the consumer’s country of residence remain unaffected.
Complete and return this form only if you wish to withdraw from the agreement. Use of this form is not mandatory. You may also submit your withdrawal through the online withdrawal function, the returns portal or by email.
